1. Acceptance of Terms
By creating an account, activating a device, or using any AOVIS product or service, you agree to be bound by these Terms of Service. If you do not agree, do not use our products or services. You must be at least 18 years old to use our services.
Company, Brand, and Domain Names
This website and related services are operated by Fifth Key Element Co., Limited, a company registered in Hong Kong. AOVIS is a brand operated by Fifth Key Element Co., Limited.
The primary domain for AOVIS services, policies, and terms is https://aovis.app. The following domains are owned and operated by the same company and automatically redirect to the primary domain:
- https://aovis.app (Official Primary Platform)
- https://aovis.us (Auxiliary domain)
- https://aovis.uk (Auxiliary domain)
Official communications may be sent from email addresses ending in @aovis.us. All services, user accounts, subscriptions, and purchases are governed by the Terms of Service and Privacy Policy published on https://aovis.app, which serves as the official source of truth for all documentation.
2. Account Registration
You are responsible for maintaining the security of your account credentials. You may not share your account with others or create accounts on behalf of third parties. You must provide accurate information when creating your account.
3. Products and Services
AOVIS provides the AOVIS NEXA Prime 4K Cellular Security Camera hardware, cloud video storage services (powered by Amazon Web Services), AI-powered event analysis features (AI Summary and AI Indexing), and cellular data plan management (provided through our MVNO partner Eiotclub). These services together constitute an IoT platform, not a standalone hardware product.
4. Subscriptions and Billing
4-A. Subscriptions via Apple App Store or Google Play
Subscriptions purchased through the Apple App Store are governed by Apple's payment terms. To cancel, go to Settings → [Your Name] → Subscriptions on your iOS device. To request a refund, visit reportaproblem.apple.com.
Subscriptions purchased through Google Play are governed by Google's payment terms. To cancel or request a refund, go to Google Play → Subscriptions.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period through your platform account settings. AOVIS cannot cancel or refund platform-processed subscriptions on your behalf.
4-B. Subscriptions via AOVIS Website
Subscriptions purchased directly through aovis.app are billed via Stripe on a recurring monthly basis. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period; no prorated refunds are issued for unused time within a paid period. To request a refund for a direct purchase, contact [email protected] within 7 days of the charge.
4-C. Free Trial
Every new device activation includes a 30-day free trial of rolling 24-hour cloud video storage and AI features. The trial begins at device activation and does not require a payment method upfront. Upon trial expiration, you must actively subscribe to continue using cloud storage and AI features.
4-D. Cellular Data Plans
Cellular data plans are prepaid and managed through the AOVIS app via our MVNO partner. Plans do not automatically renew unless you enable auto-renewal in your account settings. You will receive a push notification before your current plan expires. For refund terms, see our Refund & Warranty Policy.
5. AI Features
AI Summary and AI Indexing features are available to users with an active paid subscription or during the free trial period. AI-generated results are provided for informational purposes only and do not constitute a guarantee of security coverage. AOVIS is not liable for security incidents occurring during periods when the camera is offline, out of power, or not recording.
If you are a resident of Illinois, use of AI features that process video data containing human images is subject to your consent under the Illinois Biometric Information Privacy Act (BIPA). You will be presented with a separate consent notice before enabling these features.
6. Prohibited Conduct
You agree to use AOVIS products and services only for lawful purposes and in accordance with our Acceptable Use Policy.
7. Intellectual Property
All AOVIS brand assets, software, application interfaces, website content, and documentation are the intellectual property of Fifth Key Element Co., Limited. User-captured video data belongs to the user. By using our cloud services, you grant AOVIS a limited license to store, process, and transmit your data solely to provide the contracted services.
8. Disclaimer of Warranties
AOVIS services are provided “as is” without warranties of any kind. We do not guarantee uninterrupted service, 100% uptime, or that recordings will capture all events. Solar-powered and cellular-connected devices may experience connectivity gaps due to weather, network coverage, or battery conditions.
9. Limitation of Liability
To the maximum extent permitted by applicable law, AOVIS's total cumulative liability to you for any claims arising out of or related to these Terms or our services shall not exceed the greater of (a) the total fees paid by you to AOVIS in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) fifty U.S. dollars (US$50).
In no event shall AOVIS be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or loss of security coverage.
10. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the use of our services shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA), conducted in English. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
Nothing in this section limits your rights under applicable mandatory consumer protection laws of your jurisdiction.
11. Termination
AOVIS may suspend or terminate your account if you violate these Terms or our Acceptable Use Policy. You may close your account at any time by contacting [email protected]. Upon account closure, your data will be deleted within 30 days.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes through the app or by email. Continued use of our services after the effective date constitutes acceptance of the updated Terms.
